Many accidents on construction sites are covered under workers' compensation insurance, which all employers must carry.  Workers' compensation makes employers immune from personal injury lawsuits arising out of an accident.

But certain types of accidents, known as "third-party claims", are not covered by workers' compensation. Third-party claims involve suing people or companies other than your employer, such as other subcontractors, who are at fault for the accident.

However, in October 2003, the Florida legislature passed a law giving subcontractors and other third parties an immunity to litigation similar to what is enjoyed by employers. Supposedly, you must prove gross negligence, such as willfully ignoring safety regulations. But this law has not made it all the way through the appellate process, and our lawyers are eager to find out if it is truly enforceable.
